I would guess that Malkin will be grandfathered in under the old Euro rule (that was in place until this summer) in which you had their rights for as long as they were in Europe.

Or maybe Pronger blows his knee out, Niedermayer is abducted by Aliens, Selannee breaks a nail, the Ducks finish dead last and the Oilers draft Malkin...

That'd be some sweet justice ;)
